Unforeseen ground conditions: when geotechnical risk becomes a tender-price or no-bid issue

How site investigations, geotechnical baselines, rock classifications, groundwater data, reliance clauses and physical-condition relief mechanisms should be tested before pricing excavation, foundations, tunnels, dams and major earthworks.

Ground risk is rarely just a geotechnical issue. It is a contract-definition issue, a quantity issue and a schedule issue at the same time. A bidder should distinguish information provided 'for information', information that may be relied upon, contractual baselines and actual risk allocation under the Conditions of Contract. A thick geotechnical report does not protect the contractor if the contract says the contractor is deemed to have independently verified all subsurface conditions.

The pricing questions are practical: what proportion of excavation is soil, weathered rock or hard rock; what ripping or blasting restrictions apply; what groundwater pumping is foreseeable; are disposal areas available; is excavated material reusable; are foundation levels fixed; and what happens if weak strata extend below the assumed depth? Each assumption should be linked to a measurable baseline or a clarification. Otherwise the contingency can become arbitrary.

The no-bid threshold appears when the risk is both high-impact and unbounded. Examples include deep foundations with little subsurface data, tunnel alignments with no meaningful baseline, dredging where contamination and material classification are undefined, or a dam foundation where the contractor assumes all geological treatment without a relief mechanism. These risks can exceed the entire expected project margin.

The bid team should therefore create a ground-risk register separating quantity variance, productivity variance, equipment-method change, disposal, groundwater, support/temporary works and programme effects. If the contract provides relief for unforeseeable physical conditions, the team must also understand notice, records and comparison-baseline requirements before relying on that relief commercially.
