Does an international tender automatically qualify for Turkish stamp-tax and fee exemptions?

Why 'international tender' is not enough by itself, how Turkey's VRHİB framework works, and which documents, periods and transaction parties must be checked before assuming an exemption.

The safe answer is no: a contract being internationally financed or described commercially as an 'international tender' does not by itself prove that every related document and transaction is exempt from Turkish stamp tax and fees. Türkiye has a specific statutory and administrative framework for export and other foreign-currency-earning activities. The Ministry of Trade explains that eligible activities may benefit through a Vergi, Resim, Harç İstisnası Belgesi (VRHİB) or, for specified transactions, through document-free application where the legislation allows it. The exact activity, document, timing, parties and amount therefore matter.

The current Ministry of Trade guidance identifies the framework around decisions and communiqués governing tax, duty and fee exemptions for export-equivalent sales, deliveries and foreign-currency-earning services. The General Communiqué published by the Revenue Administration explains that, for VRHİB-linked activities, exemptions generally operate within the document's validity period and amount. It also contains special rules for certain pre-contract securities and tender decisions. This means the bid team should not wait until contract signature to ask whether the tax treatment matters; securities, tender decisions and pre-contract paperwork may already create exposure.

The project should therefore carry a tax-exemption matrix rather than a yes/no note. For every material document or transaction, record the legal entity, counterparty, document date, amount, VRHİB or other supporting basis, validity period, responsible adviser and evidence that the exemption applies. Separate the employer-facing contract from downstream supplier and subcontractor transactions because the rules are not automatically identical. A tender price that assumes blanket exemption without this mapping can understate cost and later create a dispute between commercial, finance and project teams.
